تعلن شركة MDAEdge عن توفر وظيفة مستشار عقود (Contract Advisor) في الشرقية، الظهران، السعودية. نحن نبحث عن مستشار عقود ذي خبرة في مجال صناعة الإنشاءات للانضمام إلى فريق إدارة المشاريع (PMT) المسؤول عن تنفيذ مشاريع رأسمالية عالمية المستوى بأعلى معايير السلامة والجدول الزمني والميزانية.
المهام والمسؤوليات
- العمل بشكل مستقل وكجزء من فريق لدعم جميع المهام المتعلقة بالعقود.
- مراجعة القضايا التعاقدية بشكل موضوعي وحل أوامر التغيير المتنازع عليها بطريقة استباقية وتحقيق الحلول المناسبة.
- تطوير/مراجعة أنواع مختلفة من العقود/الاتفاقيات للمشاريع.
- إدارة العقود وضمان تنفيذ جميع الشروط والأحكام من قبل جميع المشاريع.
- تطوير ومراجعة استراتيجية التعاقد وخطة لأنواع مختلفة من المشاريع.
- إجراء تحليل السوق لتحديد أفضل نوع عقد للمشروع وتقديم البدائل.
- تنفيذ دليل المشتريات الخاص بنا لجميع العقود والمراقبة الواعية للتنفيذ.
- تطوير/مراجعة حزم أوامر التغيير وضمان الامتثال للإرشادات والإجراءات ذات الصلة.
- تطوير/مراجعة استراتيجيات التفاوض بشأن أوامر التغيير.
- المشاركة في اجتماعات التفاوض لجميع أوامر التغيير.
- ضمان تنفيذ تقييم أداء الموردين من قبل فرق المشروع.
- إجراء/المشاركة في جلسات إرشادية مع المقاولين ذوي الأداء المنخفض وتسجيل الإجراءات المطلوبة.
- تقديم استشارات تعاقدية لفرق المشروع لحل أي مشكلات/نزاعات.
- تقديم ملاحظات لفرق المشروع حول شروط وأحكام العقد لتجنب حدوث نزاعات أو خرق للعقد.
- تطوير/مراجعة تعديلات العقود.
- تنفيذ إجراءات إغلاق العقد عند اكتمال المشروع.
- إعداد/مراجعة تقارير التعاقد للإدارة.
- إعداد/مراجعة أنواع مختلفة من الاتفاقيات/مذكرات التفاهم مع الأطراف الخارجية والمشاريع المشتركة المحتملة.
الشروط والمتطلبات
- درجة البكالوريوس في إدارة الأعمال أو الهندسة أو القانون/إدارة العقود من برنامج معترف به ومعتمد؛ يفضل درجة متقدمة.
- خمسة عشر عاماً من الخبرة المتخصصة في التعاقد في مجالات التصميم والاستشارات والمشاريع المشتركة وعقود الإنشاءات المتعلقة بصناعات التكرير والبتروكيماويات.
- خبرة واسعة في مجال العقود (خبير في المجال).
المهارات المطلوبة
- مهارات ممتازة في التواصل اللفظي والكتابي باللغة الإنجليزية.
- فهم مبادئ وأفضل ممارسات إدارة العقود.
- موقف ديناميكي تجاه تحسين العمليات.
- المرونة للعمل في فرق متعددة الجنسيات والتنقل إلى مواقع مختلفة بما في ذلك المناطق النائية حسب الحاجة.

Job Overview:
- We are seeking an experienced Contracts Advisor who is experienced in the construction industry to join our Project Management team (PMT).
- Our Project Management Teams are responsible and accountable for the delivery of best-in-class capital projects.
- PMT is directly involved in executing and managing assigned projects safely, on schedule, within budget and to the highest standards of integrity and compliance. This will involve engineering design, procurement and construction of various sizes ($), types and complexity of small, medium to multi-billion-dollar mega projects.
- Project Management Team manages and executes projects from multiple site offices or engineering contractor design offices throughout the Kingdom of Saudi Arabia.
- The Contracts Advisor primary role is to develop contracts and administrate related functions.
- Work both independently and part of a team to support all contract related tasks.
- Review contractual issues objectively, and resolve disputed change orders in proactive manner and achieve appropriate resolutions.
- Develop/ review different types of contracts/agreements for the projects.
- Administer the contracts and ensure all terms and conditions are implemented by all projects.
- Develop review contracting strategy & plan for different types of projects.
- Conduct market analysis to determine the best type of contract for the project and provide alternatives.
- Implement our Procurement Manual for all contracts and consciously monitor implementation.
- Develop/review change order packages and ensure compliance to related guidelines and procedures.
- Develop/review negotiation strategies for change orders.
- Participate in negotiation meetings for all change orders.
- Ensure implementation of the supplier performance evaluation by project teams.
- Conduct/participate in counselling sessions with low performing contractors and log the required actions.
- Provide contracting consultations to project teams to resolve any issues/ disputes.
- Provide feedback to project teams regarding contract terms and conditions to avoid occurrence of disputes or breach to the contract.
- Develop/review contract amendments.
- Perform contract closeout actions upon project completion.
- Prepare/review contracting reports to management.
- Prepare/review different types of agreements/MOUs with external parties and potential JVs.
- As the successful candidate you will hold a Bachelor's degree in Business, Engineering or Law/contracts Management from a recognized and approved program; an advanced degree is preferred.
- You will have fifteen years of specialized contracting experience in design, consultancy, Joint Ventures, and construction contracts/agreements related to refining and the petrochemical industries
- You will have excellent English verbal and written communication skills
- You must have an understanding of contract administration principle and best practices.
- You will demonstrate a dynamic attitude towards process improvements
- You will have the flexible to work in multinational teams and mobilize to different locations including remote are as needed.
